Today we have unusable offices, mobility difficulties, connectivity problems, affected archives or systems, and public officials who must concentrate all their efforts on responding to the emergency and protecting communities. That is why President Abelardo de la Espilella signed Legislative Decree 1384 on September 9, which allows the public administration to temporarily adapt to the circumstances caused by the earthquake and continue providing its services, especially in the most affected areas. What does this decree consist of? In which public entities may temporarily modify their opening hours and service days. They will also be able to relocate their service points, enable mobile or shared offices, implement working from home when necessary, and reschedule activities that are not a priority in the face of the emergency. The objective is concrete: to ensure that the difficulties caused by the tragedy do not become new barriers for citizens. Alternative service channels may also be enabled , allowing the later delivery of certain documents and directly consulting information already held in the systems of the State or other public entities. This avoids placing a documentary burden on citizens that the administration itself can resolve through its databases and institutional mechanisms. However, it is important to point out with absolute clarity that simplifying a procedure does not mean eliminating controls. Verification of identity, protection of rights, and compliance with essential requirements remain in place. Nor may actions necessary to protect life, personal integrity or fundamental rights be suspended. The decree also stipulates that during the year 2026, documents that a person has already submitted and that are held by the entity can be reused when they contract with it again. The administration will be able to directly consult the background and possible disqualifications. However, it will still be required to verify suitability, experience and other requirements established by law. As regards selection processes and merit-based competitions, they may be postponed until December 31, 2026, when their development could affect the participation on equal terms of the people directly affected by this tragedy. These processes will continue from January 1, 2027, from the stage at which they were suspended. Finally, the government will be able to create temporary staffing plants to exclusively address the extraordinary needs of the emergency. These plants will require a favorable opinion from the public service, budget availability, and compliance with the principles of merit and transparency. Its maximum validity will be until December 31, 2026. In short, Legislative Decree 1384 of September 9 seeks to ensure that while Colombia rebuilds what the earthquake destroyed, the State also has the capacity to reorganize itself, simplify what is necessary, and put its resources and human talent where they are most needed.
