Colombians, public works projects funded by taxes to rebuild affected territories. Let's begin. After an emergency like the one our country has experienced, rebuilding cannot be a distant promise. Families need to get their homes back, students need to return to their schools, patients need to have access to health services again, and communities need to regain access to drinking water, energy, roads, and the essential conditions to live with dignity. Therefore, President de la Espiella signed Legislative Decree 1389, an extraordinary measure to accelerate the reconstruction of the territories affected by the earthquake of August 10. This decree temporarily creates a special tax-for-works scheme for reconstruction. Its purpose is to allow taxpayers to allocate part of their tax obligations to finance and execute projects of public interest in the municipalities and districts affected by the emergency. What does this mean? That the private sector will be able to participate so that a portion of its taxes can be used for projects that directly benefit the affected communities. The projects may contribute to the recovery, rehabilitation, reconstruction, replacement, reinforcement and improvement of infrastructure in fundamental sectors such as housing, education, health, drinking water, basic sanitation, energy, roads, bridges, airports, transport, connectivity, productive infrastructure, sports venues and disaster risk management . These works must be directly related to the damage caused by the earthquake and its aftershocks and respond to the needs of the affected population. The decree also establishes a very clear rule. The resources may not be used to finance private goods or works intended for the private benefit of a company. It is a tool to rebuild the public sector, restore essential services, and protect the well-being of communities. To organize this process, the bank of projects for works for taxes for reconstruction is created, administered by the Territorial Renewal Agency with the articulation of the National Planning Department under the leadership of Dr. Julián Buitrago and the competent national entities. Projects must meet technical, budgetary, environmental and sustainability requirements and have the corresponding feasibility studies. The urgency of the emergency does not mean giving up on planning, transparency, or control of public resources. The decree, in fact, contemplates more streamlined procedures for reviewing and approving projects without reducing quality standards. The competent authorities will have up to 15 business days to issue their opinions once the documentation has been completed. Prioritization will take into account the magnitude of the damage, the importance of the affected infrastructure, the number of people benefited, the maturity of the project, and its capacity to restore essential services and support economic and social recovery. Special attention is also guaranteed to municipalities in the fifth and sixth categories, which usually have lower fiscal, technical and institutional capacities. At least 35% of the quota allocated to this modality must be directed to projects located in the affected municipalities. It is important to clarify that this mechanism does not in itself imply an increase in public spending or an automatic expansion of the fiscal quota. The Higher Council for Fiscal Policy, Confis, will define the maximum annual quota and its distribution according to fiscal availability and the goals established in the medium-term fiscal framework. In this way, the country will be able to combine public and private efforts, take advantage of the execution capacity of companies and direct resources towards the most urgent needs of the communities. This decree 1389 represents a concrete response to advance the reconstruction with order, responsibility and a sense of nationhood. Every home recovered, every school rehabilitated, every road restored, and every essential service that returns to operation will be a step towards Colombia's recovery. Rest assured that President Abelardo de la Priplieella and his team will continue working to ensure that the affected territories do not face the consequences of this regrettable tragedy alone. Reconstruction is everyone's responsibility: the State, businesses, local authorities, and every Colombian committed to the future of the country.
