Colombians, three decrees to protect education in the midst of the emergency. Starting. When an earthquake hits a school, the damage doesn't end with just the walls. A venue may become unusable, it may be impossible to reach it, registration processes may be altered, and it may even be necessary to temporarily change the way the school calendar is organized. Faced with a situation like this, the State must guarantee, above all, that an emergency does not end up becoming an interruption of the right to education. Therefore, President Abelardo de la Espella issued three decrees that, although they have different objectives, are part of the same response. to keep the education system functioning in the territories affected by the earthquake. These are decrees 1386, 1387 and 1388 of September 9, 2026. Let's talk about each of them. Decree 1386 aims, seeks, proposes that an affected school does not mean suspended classes. If an educational institution has been affected and can no longer provide in- person services under adequate conditions, what do we do while it recovers? Do we wait until the building is rebuilt? Of course not. The decree allows certified territorial entities in education to temporarily authorize the provision of educational services in alternative physical spaces, even outside of official premises, provided that they are suitable and safe for children's learning. However, the affected establishment must prove to the respective territorial entity that there is an impossibility or a restriction to provide the service in person at its headquarters and the use of the alternative space must be duly supported. Furthermore, the measure will only operate in the territories covered by the emergency and while the conditions of impact derived from the earthquake persist. With this decree we will achieve a temporary and targeted solution. It is important to clarify that the educational model is not being permanently changed, nor is the safety standard being lowered . The aim is to demand that these spaces have safe conditions for learning. And the scale of the problem explains why this tool was necessary. 5,309 educational establishments affected, according to the report used by the Ministry of Education. In other words, if a school was rendered unusable by the earthquake, the location may change temporarily, but the students' right to continue studying will not change. The second decree is 1387, which establishes that the emergency should not penalize resources for education. It's a less visible issue, but absolutely fundamental. The education system is financed, among other sources, with resources from the general system of participations ( SGP). And those resources are distributed taking into account other elements, such as the registration information recorded in SIMAT. Under normal conditions, when an audit finds information deficiencies that produce a higher turnover than it should have, Law 715 establishes that those resources can be deducted from the allocation of the following year. The problem is that 2026 has not been a normal year for the territories hit by the earthquake. There are destroyed or disabled campuses, with connectivity problems, difficulties in collecting documents, and alterations in student attendance and attendance. All of this can affect the possibility of completing a registration audit process normally. That is why this decree makes an important decision. It suspends exclusively for the registration of the 2026 validity for the certified territorial entities affected whose situation is objectively accredited the financial consequence foreseen in that paragraph of the previously mentioned law 715. So that? to prevent the consequences of an emergency that affected the verification process from turning into a reduction of resources allocated to finance the educational service the following year. But be careful with this because here lies one of the keys to the decree. The audit is not suspended. Inspection, surveillance, and control continue. And this measure also does not validate non-existent, duplicate, or fraudulent records. The exception only applies when there is a real and verifiable impact related to the earthquake. Furthermore, the Ministry of Education must determine which entities can access this measure based on an express request and objective and verifiable information about the impact. In other words, the funding of the educational service affected by the emergency is protected without relinquishing control over public resources. The third decree is 1388 related to the calendar so that it adapts to reality. And we have arrived at this third decree because even if we secure an alternative place to study and protect the resources to provide the service, there is another reality. that we must assume after the earthquake or after a quake, school life cannot necessarily continue exactly as planned. Therefore, Decree 1388 allows the Ministry of Education to authorize, upon prior reasoned request from the respective certified territorial entity, the reorganization, redistribution and rescheduling of academic work weeks in the territories. affected. This indicates that if circumstances caused by the tragedy make it necessary, academic weeks can be distributed over periods different from those originally planned. But again, there are limits. The flexibility is temporary, is linked exclusively to the circumstances of the emergency, cannot affect the rights of workers in the education sector and cannot in any way be used to establish different dates for the completion of the academic calendar between official establishments belonging to the same certified territorial entity. It's a way of giving the education system something that, in an emergency, turns out to be indispensable: adaptability. If we look at the three decrees together, the message is simple. The 1386 number allows you to find where to study when the affected school can no longer operate at its premises. Decree 1387 prevents the extraordinary difficulties of the registration audit from financially impacting the territorial entities truly affected by the emergency in 2027. And Article 1388 allows for the temporary adjustment of the academic calendar to the actual conditions of each territory. Three different instruments, one same purpose: that the earthquake does not end up robbing our children, our young people, of their right to study. Because rebuilding a school means putting its walls back up. But rebuilding a country also means ensuring that while those walls are being rebuilt, education remains standing.
