針對立法院咨請公布制定《臺灣兒少成長及未來帳戶條例》 總統批示:本條例違反權力分立原則、侵犯行政權

The President also sends a letter to the deans of the executive, legislative, judicial, and examination houses, and the Secretary-General of the Presidential Office also sends a letter to the Secretary-General of the Control Yuan.

"In response to the challenge of the declining child population, I have convened a national security meeting and proposed a new population strategy - family support. One of the important policies is the 0-18-year-old growth allowance. The budget has been included in the 2027 central government general budget.

“This Ordinance, passed on the third reading by the Legislative Yuan, not only exacerbates the gap between the rich and the poor, violates the principle of proportionality, and violates the legal principles of taxation, it also infringes upon the power of this Court to formulate policy plans and propose budgets in accordance with the Constitution, and violates the separation of powers.

The Court is the country's highest administrative agency. Within the scope of its constitutional authority, it has completed a comprehensive policy plan to promote Taiwan's new population strategy, build a comprehensive family support system, and draft relevant bills including the Gender Equality Act, Employment Insurance Act, etc. and submit them to the Legislative Yuan for review. The required funds have been included in the central government's general budget for 2016.

In order to safeguard the constitutional order and the authority of this court, I have decided not to countersign this Ordinance based on the right of countersignature granted to the President of the Executive Yuan by the Constitution. "

Kuo Yahui added that the Legislative Yuan passed the "Taiwan Children's Growth and Future Account Ordinance" on the third reading on July 24 this year, and asked the president for promulgation on August 7.

總統府發言人郭雅慧今(17)日表示,總統針對立法院咨請公布制定《臺灣兒少成長及未來帳戶條例》一案,於令文案批示本條例違反權力分立原則、侵犯行政權;行政院長卓榮泰並加註不予副署意見,以捍衛憲政秩序及行政院權限。總統另以箋函致行政、立法、司法、考試四院院長,總統府秘書長並以箋函致監察院秘書長。 「因應少子女化挑戰,本人已經召開國家安全會議,提出人口新戰略─家庭支持篇,其中一項重要政策即是0-18歲成長津貼,預算並已編入2027年中央政府總預算。 請行政院應採必要作為,俾利順利推動各項人口政策,打造幸福台灣。」 「立法院三讀通過之本條例,除加劇貧富差距,違反比例原則,並有違租稅法律原則外,尤侵害本院依憲法形成施政計畫及提出預算之權,而違反權力分立。 本院為國家最高行政機關,在憲法權限範圍內,已有完整之施政計畫推動台灣人口對策新戰略,全方位建構家庭支持系統,並擬具包括性別平等法、就業保險法等相關法案送請立法院審議,所需經費業編入116年度中央政府總預算。 為捍衛憲政秩序及本院權限,本人決定基於憲法賦予行政院院長之副署權,就本條例不予副署。」 郭雅慧補充,立法院於今年7月24日三讀通過《臺灣兒少成長及未來帳戶條例》,並於8月7日咨請總統公布。
