In order to ensure peace and stability in the region, it is important to strengthen measures in the area of ​​economic security.

This time, I would like to introduce the ``Act to Partially Amend the Foreign Exchange and Foreign Trade Act,'' which was passed at the Diet session that closed last month, in order to appropriately respond to investments that may harm national security.

The Foreign Exchange and Foreign Trade Act (Foreign Exchange Act) maintains the principle of ``freedom of foreign transactions,'' and stipulates the ``Inward Direct Investment Examination System,'' which requires prior notification and is subject to examination by the Minister of Finance and the minister in charge of the business when a foreign investor acquires shares of a Japanese corporation operating a designated industry from the perspective of ensuring national security.

As the scope of security is rapidly expanding to include the economic field, the role that this ``Inward Direct Investment Screening System'' should play from the perspective of economic security has become even more important, and we have decided to improve the sophistication of this system.

Specifically, in order to "ensure the efficiency and effectiveness of examinations," ・In addition to clarifying measures to eliminate the risk of harming national security, etc. as items that should be reported, ・The act of indirectly acquiring the stocks, etc. of a Japanese company through acquisition, etc., of a foreign corporation that owns the stocks, etc. of a Japanese company, by another foreign investor, etc., has been added to the scope of regulations.

In addition, in order to "respond to environmental changes such as security," ・Investment activities of domestic investors that are under the control or influence of foreign governments, etc. are also subject to prior notification in certain categories. ・Reports are required in certain cases even for investments made by foreign governments and other high-risk investors that are not subject to prior notification, and recommendations and orders for the disposal of stocks, etc. can be made as necessary.

Furthermore, in order to "strengthen the cross-ministerial enforcement system," we recently established the Japan Foreign Investment Committee (JFIC), which requires the Minister of Finance and the minister in charge of business to consult the heads of relevant administrative agencies when necessary from the perspective of national security.

I made the ``Japan Foreign Investment Committee (JFIC)'' a manifesto during the Liberal Democratic Party presidential election from the perspective of strengthening economic security, and it was also stated in the coalition government agreement between the Liberal Democratic Party and Japan Restoration Party that we would aim to establish it during the recent Diet session.

Regarding the inward direct investment screening system, I have long had a strong awareness that the screening capabilities of the relevant ministries and agencies must be improved, and that it should not be vertically siled.

In order to address these issues, the Japan Foreign Investment Committee (JFIC) will strengthen the sharing of screening know-how and information sharing, including on the risk attributes of foreign investors, and raise the screening capabilities of the government as a whole. Additionally, we will build a system that allows cross-ministerial verification of the significance of the businesses and technologies owned by Japanese companies in which we invest in the supply chain of defense equipment and critical supplies.

Conducting consistent examinations across ministries and agencies in this way will ultimately lead to greater predictability for foreign investors, and through these efforts, we will achieve both ``promoting sound investment'' and ``ensuring economic security.''

地域の平和と安定のため、「経済安全保障分野」の施策を併せて強化していくことが重要です。 今回は、先月に閉会した国会で成立した、国の安全などを損なうおそれがある投資に対して適切に対応するための『外国為替及び外国貿易法の一部を改正する法律』についてご紹介します。 『外国為替及び外国貿易法(外為法)』では、「対外取引自由」を原則としつつ、外国投資家が、国の安全の確保などの観点から指定された業種を営む日本法人の株式の取得等を行う場合に、事前届出を求め、財務大臣・事業所管大臣が審査を実施する「対内直接投資審査制度」を定めています。 安全保障の裾野が経済分野に急速に拡大する中、経済安全保障の観点で、この「対内直接投資審査制度」が果たすべき役割は一層重要となっており、同制度の高度化を図ることとしました。 具体的には、「審査の効率化・実効性確保」に向けて、 ・国の安全等を損なうリスクを無くするための措置を、届出すべき事項として明確化したほか、 ・本邦企業の株式等を保有する外国法人等を別の外国投資家が買収等により支配することを通じ、間接的に本邦企業の株式等を取得する行為について、規制対象に追加しました。 また、「安全保障等の環境変化への対応」のために、 ・外国政府等の支配・影響下にある国内投資家の投資活動についても、一定の類型においては、事前届出等の対象としたほか、 ・外国政府等の類型的に特にリスクが高い投資家による、事前届出の対象でない投資についても、一定の場合に報告を求め、必要に応じ、株式等の処分等の勧告・命令ができるようにしました。 さらに、「省庁横断的な執行体制の強化」のために、国の安全等の観点から必要な場合に、財務大臣及び事業所管大臣から関係行政機関の長への意見照会を義務付けることとし、先般、『対日外国投資委員会(JFIC)』を創設しました。 『対日外国投資委員会(JFIC)』は、私が、経済安全保障を強化する観点から自由民主党総裁選挙の公約としても掲げ、また、自由民主党・日本維新の会の連立政権合意書においても、先の国会中の創設を目指すこととしていたものです。 私は、かねてより、「対内直接投資審査制度」につきまして、関係省庁の審査能力を向上させなければならない、また、縦割りであってはならない、という強い問題意識を持っていました。 こうした課題に対処するため、『対日外国投資委員会(JFIC)』では、審査のノウハウの共有や、外国投資家のリスク属性等を始めとする情報連携を強化し、政府全体として審査能力を底上げしていきます。 また、投資先の日本企業が営む事業や保有する技術が、防衛装備品や重要物資のサプライチェーン上どのような意味を持つかといった点を、省庁横断的に検証できる体制を構築していきます。 こうして省庁横断的に、一貫性のある審査を行うことは、ひいては外国投資家の予見可能性を高めることにもつながるため、こうした取組を通じ、「健全な投資の促進」と「経済安全保障の確保」との両立を実現してまいります。
