Indotel presenta propuesta de nueva Ley de Telecomunicaciones para modernizar el sector
Santo Domingo.– The Dominican Institute of Telecommunications (Indotel) presented the proposal for the General Law of Telecommunications, Digital Infrastructure and Connectivity, with which it seeks to update the legal framework of the sector and respond to the challenges of the technological transformation of the country.
The presentation was led by the member of the Board of Directors of Indotel, Fausto Rosario Adames, representing the president of the Board of Directors, Guido Gómez Mazara, in the Orlando Jorge Mera Room of the institution. During his speech, he explained that the initiative is based on the progress achieved with Law 153-98, and incorporates tools in line with the current reality, marked by fiber optics, new mobile generations, satellite communications, submarine cables, data centers and other digital infrastructures.
The representative highlighted that the proposal expressly establishes that regulation will focus on networks, services, infrastructure and resources functionally linked to telecommunications, without regulating content, electronic commerce or digital platforms that are not functionally linked to the sector. In this way, it seeks to clearly delimit the regulator's scope of action and preserve freedom of innovation in other areas.
Likewise, he pointed out that among the main objectives of the project are to simplify the authorization regime through a single concession, facilitate the deployment of infrastructure through a single electronic window, promote network sharing and strengthen competition and efficient management of the radio spectrum.
The member of the Board of Directors indicated that the initiative also expands user protection through provisions on quality and continuity of services, clear information, transparent billing, number portability, accessibility for people with disabilities and complaint mechanisms.
He added that the proposal incorporates a sectoral cybersecurity regime aimed at strengthening the integrity, continuity and resilience of the networks and the digital infrastructure directly necessary for their operation.
Rosario Adames reported that the project was presented to the Legal Consulting Office of the Executive Branch and that Indotel will work together with that body to develop a dialogue process with operators, users, academies, experts, entrepreneurs and civil society organizations before sending the proposal to the National Congress.
“We want to reach the National Congress with a mature proposal, enriched by dialogue and capable of responding to the technological challenges of the coming decades,” said Fausto Rosario Adames, he noted.
The proposal seeks to lay the regulatory foundations for a more connected, inclusive, innovative and competitive Dominican Republic, through an updated legal framework in line with the technological evolution of the sector.
The meeting was attended by representatives of the main companies and organizations in the sector, including Claro, Altice, Trilogy, OneMax, Wind Telecom, Columbus, Adora and Comtec, as well as members of the Board of Directors and officials of Indotel. Lawyers Nassef Perdomo and José Luis Taveras, drafters of the draft law, were also present.

El representante destacó que la propuesta establece expresamente que la regulación se concentrará en lasredes, servicios, infraestructuras y recursos vinculados funcionalmente a las telecomunicaciones, sin regular contenidos, comercio electrónico ni plataformas digitales que no estén funcionalmente vinculadas al sector. De esta manera, busca delimitar claramente el ámbito de actuación del regulador y preservar la libertad de innovación en otros ámbitos. Asimismo, señaló que entre los principales objetivos del proyecto se encuentran simplificar el régimen de habilitaciones mediante unaconcesión única, facilitar el despliegue de infraestructura a través de unaventanilla única electrónica, promover la compartición de redes y fortalecer la competencia y lagestión eficiente del espectro radioeléctrico. El miembro del Consejo Directivo indicó que la iniciativa también amplía laprotección de los usuariosmediante disposiciones sobre calidad y continuidad de los servicios, información clara, facturación transparente, portabilidad numérica, accesibilidad para personas con discapacidad y mecanismos de reclamación. Agregó que la propuesta incorpora unrégimen sectorial de ciberseguridadorientado a fortalecer la integridad, continuidad y resiliencia de las redes y de la infraestructura digital directamente necesaria para su funcionamiento. Rosario Adames informó que elproyecto fue presentado a la Consultoría Jurídicadel Poder Ejecutivo y que el Indotel trabajará conjuntamente con esa instancia para desarrollar unproceso de diálogoscon operadores, usuarios, academias, expertos, emprendedores y organizaciones de la sociedad civil antes de remitir la propuesta al Congreso Nacional. “Queremos llegar al Congreso Nacional con una propuesta madura, enriquecida por el diálogo y capaz de responder a los desafíos tecnológicos de las próximas décadas”,afirmó Fausto Rosario Adames, señaló. La propuesta busca sentar lasbases regulatoriasparauna República Dominicana más conectada, inclusiva, innovadora y competitiva,mediante un marco jurídico actualizado y acorde con la evolución tecnológica del sector. El encuentro contó con representantes de las principales empresas y organizaciones del sector, entre ellasClaro, Altice, Trilogy, OneMax, Wind Telecom, Columbus, Adora y Comtec, así como miembros del Consejo Directivo y funcionarios delIndotel.
