Le Conseil constitutionnel a rendu plusieurs décisions importantes.

The Constitutional Council has rendered several important decisions today and in recent days. The emergency law for the protection and agricultural sovereignty and the so-called “RIPOST” law, aimed at providing immediate responses to phenomena disturbing public order, security and tranquility of our fellow citizens, have been largely validated. They respond to strong priorities set by the Government and the expectations of the French. The military programming law for the years 2024 to 2030, the law relating to the right to assisted dying and the law aimed at protecting minors from the risks to which the use of social networks exposes them, which had been the subject of commitments made by the President of the Republic to the French, have also given rise to detailed decisions. With regard to the military programming law, the Constitutional Council validated the text as a whole, including the provisions relating to national service. In an increasingly violent and uncertain geopolitical context, where the capacity of nations to fully ensure their defense is more crucial than ever, this law, which materializes the doubling in ten years of the army budget, will allow France to continue to have the most effective army in Europe, for the benefit of the security of its fellow citizens as well as that of the continent. The decision relating to the law on the right to assistance in dying completes a democratic debate exemplary, started with the opinion of the National Consultative Ethics Committee and that of the Citizens' Convention on the end of life, continued during the various readings in the National Assembly and the Senate and concluded by referral to the Constitutional Council. By validating the essential provisions of the law while formulating the details which fall within its office, the Council consolidates the balance of the text adopted by Parliament. By recognizing the conformity of this law with the principles and values ​​of the Constitution, the Constitutional Council provides an essential guarantee to our fellow citizens. It is now possible to turn to the implementation of this reform with the certainty that it is based on fully established democratic, ethical and constitutional foundations. At the same time, the law of May 26, 2026 aimed at guaranteeing equal access for all to support and palliative care will allow the development of palliative care and the implementation of the national strategy for supportive care. Finally, the law aimed at protecting minors from the risks to which the use of social networks exposes them was the subject of criticism from the Council. While, under the leadership of France, more than thirty States around the world are moving towards banning social networks for young people in the coming months and the European Commission is working on a harmonization of these provisions for the Union, the objective pursued since 2017 by the Head of State on the protection of minors online remains unchanged: to protect the best interests and health of our children while the harmful effects of social networks on them are scientifically documented. In this context, the President of the Republic has instructed the Prime Minister to work, as soon as possible, on a legally robust drafting taking into account the decision of the Constitutional Council as well as the European framework. On this basis, it will be up to the President of the Republic, the Government and Parliament to determine the ways and means to, between now and the end of the mandate, protect our children from social networks. The determination of the President of the Republic to bring this reform to fruition by spring 2027 remains total.
