Loi sur le référendum : Félix Tshisekedi sollicite une nouvelle délibération auprès du Parlement
In an official press release published this Thursday, August 13, the Office of the Lower House announces that it will include a new deliberation of this text in its work schedule.
This decision follows a request from the President of the Republic, Félix Tshisekedi, addressed to the presidents of the National Assembly and the Senate by a letter dated August 10, 2026. The Head of State requests, in accordance with article 137 of the Constitution, a new deliberation of the law on the organization of referendums.
This approach comes after the R. Const ruling. 2695 rendered on July 28, 2026 by the Constitutional Court. Seized by the President of the Republic, the High Court declared the law establishing the conditions for organizing the referendum to be constitutional, while formulating reservations concerning several of its provisions.
In its press release, the Office of the National Assembly explains that this new deliberation aims precisely to integrate the interpretative clauses formulated by the Constitutional Court in its judgment.
“Considering the particular importance of the aforementioned law in the democratic life of our country”, the Office of the National Assembly considers it necessary to have a text guaranteeing more “clarity, coherence, intelligibility and legal certainty” in the exercise of the sovereign power of the people.
The file will therefore be included in the calendar for the ordinary session of September 2026. This is a new stage in the legislative process surrounding this law, which has been the subject of significant political controversy in the DRC for several months.
The Constitutional Court had notably accompanied its declaration of conformity with reservations relating to several articles of the text, including articles 3, 4, 5, 7, 8, 9, 10, 12, 14, 19, 21, 23 and 43. It had requested that the law be published in the Official Journal with its judgment annexed, so that the reservations formulated could be taken into account in its application.
The new deliberation announced by the National Assembly comes as the question of the referendum remains at the center of Congolese political debates. The opposition accuses the government of seeking, through the referendum process, to pave the way for a modification of the Constitution likely to allow President Félix Tshisekedi to run for a third term. The presidential camp rejects these accusations and affirms that the approach aims to reform the functioning of institutions.

The next parliamentary session in September promises to be particularly busy, since the deputies will have to examine the law on referendums again in the light of the observations of the Constitutional Court and the request made by the head of state.

Dans un communiqué officiel publié ce jeudi 13 août, le Bureau de la chambre basse annonce qu’il inscrira une nouvelle délibération de ce texte à son calendrier des travaux. Cette décision fait suite à une demande du président de la République, Félix Tshisekedi, adressée aux présidents de l’Assemblée nationale et du Sénat par une lettre datée du 10 août 2026. Le chef de l’État sollicite, conformément à l’article 137 de la Constitution, une nouvelle délibération de la loi sur l’organisation des référendums. Cette démarche intervient après l’arrêt R. Const. 2695 rendu le 28 juillet 2026 par la Cour constitutionnelle. Saisie par le président de la République, la Haute Cour avait déclaré conforme à la Constitution la loi fixant les conditions d’organisation du référendum, tout en formulant des réserves concernant plusieurs de ses dispositions. Dans son communiqué, le Bureau de l’Assemblée nationale explique que cette nouvelle délibération vise précisément à intégrer les clauses interprétatives formulées par la Cour constitutionnelle dans son arrêt. « Considérant l’importance particulière de la loi susmentionnée dans la vie démocratique de notre pays », le Bureau de l’Assemblée nationale estime nécessaire de disposer d’un texte garantissant davantage de « clarté, de cohérence, d’intelligibilité et de sécurité juridique » dans l’exercice du pouvoir souverain du peuple. Le dossier sera donc inscrit au calendrier de la session ordinaire de septembre 2026. Il s’agit d’une nouvelle étape dans le processus législatif entourant cette loi, qui fait depuis plusieurs mois l’objet d’une importante controverse politique en RDC. La Cour constitutionnelle avait notamment assorti sa déclaration de conformité de réserves portant sur plusieurs articles du texte, dont les articles 3, 4, 5, 7, 8, 9, 10, 12, 14, 19, 21, 23 et 43. Elle avait demandé que la loi soit publiée au Journal officiel avec son arrêt en annexe, afin que les réserves formulées soient prises en compte dans son application. La nouvelle délibération annoncée par l’Assemblée nationale intervient alors que la question du référendum demeure au centre des débats politiques congolais. L’opposition accuse le pouvoir de chercher, à travers le processus référendaire, à ouvrir la voie à une modification de la Constitution susceptible de permettre au président Félix Tshisekedi de briguer un troisième mandat. Le camp présidentiel rejette ces accusations et affirme que la démarche vise à réformer le fonctionnement des institutions. Le communiqué de l’Assemblée nationale, daté du 13 août 2026 à Kinshasa, est signé par le rapporteur de la chambre basse, le député Jacques Djoli Eseng’Ekeli.
