“Los tiempos oscuros están quedando atrás”: Presidente Arévalo
Guatemala, August 5, 2026.- President Bernardo Arévalo today expressed his approval for the legal situation of Luis Pacheco and Héctor Chaclán, who regained their freedom after the judge handling the case granted a substitute measure.
In a message transmitted through government media, he stated that the two public servants and leaders of indigenous communities “should never have been criminalized.”
He asserted that Pacheco and Chaclán “legitimately defended the popular will” by protesting the attempts of corrupt political and economic groups to have the results of the 2023 presidential elections unknown.
Pacheco “was not only an important leader in the defense of democracy,” said the president.
“He also served Guatemala from this Government as vice minister, convinced that the democratic transformation of the country had to be built from the institutions and with full respect for the law,” he said.
He pointed out that the deprivation of liberty of Chaclán and Pacheco “represented a wound for justice, for them, for their families and for all who believe in democracy.”
“I am deeply happy with the substitute measure that has been granted to them,” President Arévalo stressed after hearing the news of the legal provision issued in favor of the two leaders.
“This is good news for Guatemala and renews hope that the dark times are behind us,” he emphasized.
In this sense, he highlighted that in Guatemala "justice must serve to protect people's rights and strengthen democracy, never to weaken it."
“Connotation of great joy”: Minister of Energy and Mines
Meanwhile, the head of the Ministry of Energy and Mines (MEM), Erwin Rolando Barrios Torres, consulted on the issue at the joint press conference held at the National Palace of Culture, also spoke out in support of the legal measure.

En un mensaje transmitido por medios gubernamentales, afirmó que los dos servidores públicos y dirigentes de comunidades indígenas “nunca debieron ser criminalizados”. Aseveró que Pacheco y Chaclán “defendieron legítimamente la voluntad popular” al protestar por los intentos de grupos políticos y económicos corruptos, a fin de que se desconocieran los resultados de las elecciones presidenciales de 2023. Pacheco “no solo fue un liderazgo importante en la defensa de la democracia”, indicó el mandatario. “También sirvió a Guatemala desde este Gobierno como viceministro, convencido de que la transformación democrática del país debía construirse desde las instituciones y con pleno respeto a la ley”, dijo. Destacó que esperaba “celebrar la buena noticia” en una reunión con el presidente Arévalo, una vez que se recupere del quebranto de salud que aqueja al mandatario. “Hay temas legales, hay temas administrativos y hay temas -sobre todo y en primera instancia- personales”. Lo importante por ahora es que ambos “estén de vuelta en casa y se reúnan con sus familiares”, luego de meses del encierro; indicó. Los procesados permanecieron en prisión un año y tres meses, como consecuencia de una aparentemente poco seria investigación a cargo de la gestión del Ministerio Público de entonces. Pacheco y Chaclán, detenidos el 23 de abril de 2025, fueron beneficiados este día con arresto domiciliario dictado por el juez que lleva el caso.
