HE The President of the Republic, José Antonio Kast, signed the Pro-Security Constitutional Reform bill through which it seeks to introduce changes in the Magna Carta to protect citizens against the actions of organized crime and terrorism. The signing, held in the Patio de las Camelas, in La Moneda, was part of the Agenda against Organized Crime and Terrorism (ACOT), presented by the president the first week of August. The initiative incorporates the following aspects: It expressly enshrines public security in the Magna Carta as a duty of the State. It creates a new State of Exception to confront serious alterations in public security caused by criminal or terrorist organizations. This reform allows the President to decree this state of exception to act in neighborhoods, polygons or territories captured by criminal organizations. It will have a limited duration, it will be renewed after being approved by Congress and the Armed Forces will be able to support the police in surveillance, logistics, perimeter control or technical support tasks. This state of exception will allow for the establishment of movement and assembly controls, as well as the requisitioning of property and access to telecommunications, among other aspects. A registry is created to officially recognize certain organizations as criminals or terrorists. The State, through a well-founded decision of the Executive and with control of the Senate, may qualify that organization based on objective criteria. Differentiated penitentiary regimes are established for the leaders of criminal or terrorist organizations. The seizure and liquidation of the assets of organized crime, drug trafficking and terrorism is facilitated. During the activity, the head of State stated that "the hand has changed. But we have to always continue advancing in the same direction, recovering security for our compatriots. The minister pointed out well, there is no freedom without security. It is even put Democracy is at risk if there is no security and we have seen this in other countries in a dramatic way, how organized crime is occupying entire territories and putting itself at the same level as the State, with the same firepower, with unfortunately influence on institutions that are permeated by organized crime." The ACOT is a robust agenda that contemplates the processing of more than 20 bills that are already in Congress and the entry of at least a dozen more.

S.E. el Presidente de la República, José Antonio Kast, firmó el proyecto de ley de Reforma Constitucional Pro Seguridad mediante el cual se busca introducir cambios en la Carta Magna para proteger a la ciudadanía frente al actuar del crimen organizado y el terrorismo. La firma, realizada en el Patio de las Camelas, en La Moneda, se enmarcó en la Agenda contra el Crimen Organizado y el Terrorismo (ACOT), presentada por el mandatario la primera semana de agosto.La iniciativa incorpora los siguientes aspectos:Consagra expresamente en la Carta Magna la seguridad pública como un deber del Estado.Crea un nuevo Estado de Excepción para enfrentar graves alteraciones de seguridad pública causadas por organizaciones criminales o terroristas. Esta reforma permite que el Presidente decrete este estado de excepción para actuar en barrios, polígonos o territorios capturados por organizaciones criminales. Tendrá una duración acotada, se renovará tras ser aprobada por el Congreso y las Fuerzas Armadas podrán apoyar a las policías en tareas de vigilancia, logística, control perimetral o apoyo técnico. Este estado de excepción permitirá establecer controles de desplazamiento y reunión, así como requisar bienes y acceder a telecomunicaciones, entre otros aspectos.Se crea un registro para reconocer oficialmente a determinadas organizaciones como criminales o terroristas. El Estado, mediante decisión fundada del Ejecutivo y con control del Senado, podrá calificar a esa organización en base a criterios objetivos.Se establecen regímenes penitenciarios diferenciados para los líderes de organizaciones criminales o terroristas.Se facilita la incautación y liquidación de los bienes del crimen organizado, narcotráfico y terrorismo.Durante la actividad, el jefe de Estado manifestó que "ha cambiado la mano. Pero nosotros tenemos que seguir avanzando siempre en un mismo norte, recuperar la seguridad para nuestros compatriotas. Bien lo señalaba el ministro, no hay libertad sin seguridad. Incluso se pone en riesgo la democracia si no hay seguridad y eso lo hemos visto en otros países de manera dramática, cómo el crimen organizado va ocupando territorios completos y se pone al mismo nivel del Estado, con el mismo poder de fuego, con influencia lamentablemente en instituciones que son permeadas por el crimen organizado".La ACOT es una robusta agenda que contempla el trámite de más de 20 proyectos de ley que ya están en el Congreso y el ingreso de, al menos, una docena más.
