Gabinete propone ley que exime del pago de ITBI a la venta de viviendas nuevas
The Cabinet Council approved this Wednesday a bill "that adds an article to Law 106 of 1974, which establishes the Tax on Transfers of Real Estate; and modifies Law 4 of 1994, which establishes the system of preferential interests for the agricultural sector."
The project was led by the Minister of Economy and Finance (MEF), Felipe Chapman, and consists of the first sale of new homes being exempt from the Real Estate Transfer Tax (ITBI), provided that this sale is formalized within the next two years from the date of issuance of the occupancy permit.
"That is, homes for middle-income families, who would not have to pay that tax for amounts of the initial B/.120,000. This is primarily focused on making it easier for lower-income Panamanian families to fulfill their dream of acquiring a home," explained the head of the MEF.
For his part, the Minister of Housing and Territorial Planning (Miviot), Jaime Jované, highlighted that the government's priority is to address the housing needs of Panamanians and promote economic growth by energizing sectors such as the construction industry. In that sense, he mentioned that in the first 24 months of President José Raúl Mulino's government, more than 6,200 housing solutions have been rescued and completed (from projects abandoned by past administrations).
"President Mulino has instructed us to review with the housing promoters, the mortgage banks, who are going to guarantee the mortgage of each of these homes, the possible solutions so that they are accessible to Panamanians who require it. Soon we will announce, in addition to this tax or this exemption from the real estate transfer tax, what will come as the initial Pa'Ti payment, which will reduce the impact of the first purchase to that citizen who needs it so much," he stressed.
Meanwhile, the Minister for Canal Affairs and Secretary of Goals, José Ramón Icaza, explained that the exoneration of the ITBMI is part of the National Government's strategy to generate more than 80 thousand jobs, as announced by President Mulino on July 1, energizing the construction industry and generating the conditions for this sector to reach the potential that it was already registering before the pandemic.
Regarding the aforementioned bill, the exemption will be equivalent to the first B/.120 thousand of the total value of the sale. The tax will be paid by the seller, and any agreement through which the seller transfers to the buyer, directly or indirectly, the obligation to pay this tax will be null and void.
The project adds that, when the sale is greater than B/.120 thousand and does not exceed B/.200 thousand, the real estate transfer tax will be calculated only on the surplus of B/.120 thousand, exclusively applying the following preference scale, according to the total value of the home:

This project has the purpose of facilitating access to housing for the most vulnerable families.

El Consejo de Gabinete aprobó este miércoles un proyecto de ley "que adiciona un artículo a la Ley 106 de 1974, por la cual se establece el Impuesto a las Transferencias de Bienes Inmuebles; y modifica la Ley 4 de 1994, que establece el sistema de intereses preferenciales al sector agropecuario”. El proyecto estuvo a cargo del ministro de Economía y Finanzas (MEF), Felipe Chapman y consiste en que la primera operación de venta de viviendas nuevas esté exenta del Impuesto a la Transferencia de Bienes Inmuebles (ITBI), siempre que esta venta se formalice dentro de los dos siguientes años contados a partir de la fecha de expedición del permiso de ocupación. “Es decir, viviendas para la familia de ingresos medios, que no tendrían que pagar ese impuesto para los montos de los B/.120.000 iniciales. Esto está enfocado, primordialmente, en facilitar que las familias panameñas de menores ingresos puedan cumplir su sueño de adquirir una vivienda”, explicó el titular del MEF. Por su parte, el ministro de Vivienda y Ordenamiento Territorial (Miviot), Jaime Jované, destacó que la prioridad del gobierno es atender las necesidades de vivienda de los panameños e impulsar el crecimiento económico dinamizando sectores como la industria de la construcción. En ese sentido, mencionó que en los primeros 24 meses del gobierno del presidente José Raúl Mulino se ha logrado rescatar y terminar (de proyectos abandonados por pasadas administraciones) más de 6,200 soluciones de viviendas. “El presidente Mulino nos ha dado instrucciones de revisar con los promotores de vivienda, los bancos hipotecarios, que van a garantizar la hipoteca de cada una de estas viviendas, las posibles soluciones para que sean accesibles a los panameños que así lo requieran. Próximamente vamos a anunciar, además de este impuesto o esta exoneración del impuesto de transferencia de bienes inmuebles, lo que va a venir como el abono inicial Pa´Ti, el cual reducirá el impacto de la primera compra a ese ciudadano que tanto lo necesita”, subrayó. En tanto, el ministro para Asuntos del Canal y secretario de Metas, José Ramón Icaza, explicó que la exoneración del ITBMI es parte de la estrategia del Gobierno Nacional para generar más de 80 mil empleos, como lo anunció el presidente Mulino el pasado 1 de julio, dinamizando la industria de la construcción y generando las condiciones para que este sector alcance el potencial que ya venía registrando antes de la pandemia. En cuanto al citado proyecto de ley, la exención equivaldrá a los primeros B/.120 mil del valor total de la venta. El impuesto será pagado por el vendedor, y será nulo de pleno derecho cualquier acuerdo mediante el cual el vendedor traslade al comprador, directa o indirectamente, la obligación de pagar este impuesto. Agrega el proyecto que, cuando la venta sea superior a los B/.120 mil y no exceda de B/.200 mil, el impuesto de transferencia de bienes inmuebles se calculará únicamente sobre el excedente de B/.120 mil, aplicando exclusivamente la siguiente escala preferencia, según el valor total de la vivienda: Hasta B/.120,000.00 Exenta (0%) B/.120,001.00 hasta B/.130,000.00 0.50% B/.130,001.00 hasta B/.150,000.00 1.00% B/.150,001.00 hasta B/.170,000.00 1.40% B/.170,001.00 hasta B/.190,000.00 1.60% B/.190,001.00 hasta B/.200,000.00 1.80% Este proyecto tiene el propósito de facilitar el acceso a la vivienda a familias más vulnerables.
