Presidente Abinader emite el Decreto núm. 502-26 para fortalecer la prevención del ingreso de mercancías vinculadas al trabajo forzoso
Santo Domingo.–The Executive Branch issued Decree no. 502-26, through which it establishes the administrative procedure to prevent, identify and restrict the importation of merchandise, products and goods produced, in whole or in part, through forced labor, strengthening the protection of human rights and compliance with the international commitments assumed by the Dominican Republic.
In the document, the General Directorate of Customs (DGA) is empowered to order, through a reasoned decision, the prohibition of the import of merchandise, products or goods when it is determined that they were produced through forced labor.
It also establishes that the administrative measures will be applicable to goods that have already set sail, are in port or are subject to any customs regime or operation prior to their importation or definitive entry into the national territory.
In addition, the DGA may order, as appropriate, re-exportation to the country of origin or to another authorized destination, as well as its destruction or any other legally appropriate measure.
This institution must, likewise, keep an administrative record of the merchandise, products and goods whose import has been prohibited.
Likewise, the strengthening of international cooperation, the exchange of information and the adoption of good practices with organizations and authorities of other States is promoted to identify goods potentially produced through forced labor.
Interinstitutional coordination
Another of the articles contained in Decree no. 502-26, provides for inter-institutional coordination between the General Directorate of Customs, the Ministry of Labor, the Public Ministry, the Ministry of Industry, Commerce and MSMEs, the Ministry of Foreign Affairs and other competent entities to strengthen prevention and control in international trade.

Además, laDGApodrá disponer, según corresponda, lareexportaciónal país de procedencia o a otro destino autorizado, así como sudestruccióno cualquier otra medidalegalmenteprocedente. Esta institución deberá, de igual modo, llevar unregistro administrativode las mercancías, productos y bienes cuya importación haya sido prohibida. Asimismo, se promueve el fortalecimiento de lacooperación internacional, el intercambio deinformacióny la adopción debuenas prácticascon organismos y autoridades de otros Estados para identificar mercancías potencialmente producidas mediante trabajo forzoso. Coordinación interinstitucional Otro de los artículos contenidos en elDecreto núm. 502-26, dispone lacoordinación interinstitucionalentre la Dirección General de Aduanas, el Ministerio de Trabajo, el Ministerio Público, el Ministerio de Industria, Comercio y Mipymes, el Ministerio de Relaciones Exteriores y demás entidades competentes para fortalecer laprevención y el controlen el comercio internacional.
