According to the said press release, these structures sent a communication to the Office of the Prosecutor of the International Criminal Court and are trying to pass it off as a procedure initiated against the President of the Republic, Félix Antoine Tshisekedi Tshilombo.

“The reality is clear: no investigation, no decision, no warrant, no charge and no open case against the President of the Republic has been established. The newspaper Le Soir contradicts itself: its title states a “referral to the ICC for crimes against humanity committed in Katanga”, while its own article recognizes that the decision to open or not a file still belongs to the Prosecutor,” indicates the press release signed by Me Sonny Kabeya Mukanya, secretary general of the structure.

The non-profit organization United Front for the DRC emphasizes that “Article 15 of the Rome Statute authorizes the transmission of information to the Prosecutor; it creates neither investigation nor case. Without a decision from the Prosecutor, talking about a “referral” against the President is legally misleading. In Belgian law, article 443 of the Penal Code punishes the public and malicious imputation of a specific fact damaging to honor. The authors will have to answer for their assertions.”

In the process, the United Front for the DRC affirms that the calendar is not innocent.

“This operation is being publicized at the precise moment when the DRC, as part of its presidency of the United Nations Security Council, is organizing a meeting according to the Arria formula on the links between natural resources, war economies, conflicts and peace. While Kinshasa exposes the looting of its wealth and carries the voice of the wounded populations, some seek to divert attention to its President,” we read in the press release.

In addition, this non-profit organization points out that this maneuver targets the DRC at a time when it is bringing the voice of its victims to the UN and denouncing the looting of its resources.

“Katanga is not the property of a few pharmacies based in Brussels, much less a tool serving Rwandan propaganda. We will defend, without retreat, national unity, sovereignty and dignity of the Congolese people,” insists the United Front for the DRC.

The United Front for the DRC rejects what it describes as an amalgamation between the Kasaïan origin of the head of state and that of people to whom certain acts are attributed.

“A provincial origin is neither proof, nor an order, nor a chain of command. Katanga is not a political asset and cannot be used to oppose the Congolese. Consequently, the United Front formally puts the promoters of this operation on notice to correct their statements and take legal responsibility for their accusations. A request for rectification is also sent to the newspaper Le Soir. Failing this, appropriate civil, criminal and ethical measures will be taken,” warns the United Front for the DRC.
