Comisión de Revisión de la Ley 16-26 aprueba protocolo de aplicación y adopta medidas para iniciar el proceso de pago de las deudas a contratistas
Santo Domingo.- In compliance with the mandate conferred by Law 16-26, which authorizes payment to State contractors and creates a commission to review claims arising from works carried out with or without a formal contract, the first work session was held in which a protocol for the application of the aforementioned legislation was approved and In this way, honor commitments to third parties that meet established requirements.
The approval was adopted by the commission established by law, which is made up of the Minister of Finance and Economy, Magín Díaz, who chairs it; the Comptroller General of the Republic, Geraldo Espinosa Pérez; the director of Budget, José RijoPresbot, and Carlos Pimentel, director of Public Contracting.
In general terms, the members of the commission approved fundamental decisions that are aimed at establishing the cooperative framework for the implementation of the aforementioned legislation and advancing the recognition and payment of the State's debts with contractors covered by these regulations under transparency guidelines.
In this sense, the approved protocol for the application of Law 16-26 establishes the procedures, criteria and technical requirements that will govern the process of review, evaluation and processing of files, which will be public knowledge.
This protocol represents a decisive step for the execution of legislation, by providing the process with clear, uniform and agile rules for the knowledge of files, maintaining the legal security of administrative actions.
Likewise, the commission ordered its referral to the overseers and all institutions covered by said legislation, in order to ensure the correct application of the established procedures, including the contemplated supervision and accountability.
The commission reiterated that it is a priority objective to advance as quickly as possible in the effective implementation of the aforementioned law, creating the administrative, technical and operational conditions necessary to begin the payment process of the debts recognized by this legislation.
In that order, priority will be given to those files that, at the time of the entry into force of the regulations, were in the process of review by the Comptroller General of the Republic.
The commission reaffirms its commitment to continue working in a coordinated manner with the institutions that comprise it, the control bodies and the representatives of society who participate as overseers, with the objective of guaranteeing responsible compliance with the obligations of the State and strengthening the trust of citizens in the public Administration.
It should be remembered that the legislation impacts contractors of works carried out for entities such as the Ministry of Public Works, Ministry of Education, National Institute of Drinking Water and Sewage (Inapa), National Institute of Hydraulic Resources (Indrhi), Corporación del Acueducto y Alcantarillado de Santo Domingo (Caasd), the former Office of Supervisory Engineers of State Works (Oisoe) and other state institutions.
