Gobierno emite reglamento que establece la estrategia nacional para convertir los servicios públicos en proactivos
Santo Domingo.– Through Decree number 384-26, the Dominican Government announced the regulations that launch the National Strategy for Proactive Services, an initiative that seeks to promote the progressive transition of public services towards an anticipatory management model based on life events.
The decree defines as the objective of the regulation the establishment of the mandatory minimum framework for the design, implementation, operation, monitoring and evaluation of proactive services in the Public Administration under the Executive Branch.
It explains that the strategy will be articulated through a National Portfolio for Life Events and will be executed based on interoperability, data governance, traceability, auditing, omnichannel service, correction and complaint mechanisms, along with human supervision when the nature of the case or the legal system requires it.
The Minister of Public Administration, Sigmund Freund, expressed his satisfaction with this provision and indicated that this regulation marks the beginning of a new public management model that will place the country at the forefront of the transformation of public services in the region.
“This is a process that allows us to move from a reactive and bureaucratic administration model towards an anticipatory State that is based on secure interoperability and data exchange between our institutions, and thus be able, through the automatic detection of what we know as life events, such as birth, education, employment, retirement, to proactively define the services that will be required in the future,” said Freund.
Purpose, direction and scope of application
The provision of the Executive Branch states that the purpose of the regulation will be to promote the progressive transition towards a public administration capable of acting ex officio in the face of life events or legally verified eligibility conditions.
The decree defines as a mandatory scope of application the ministries, bodies, entities and agencies of the central and functionally decentralized Public Administration, under dependence or tutelage of the Executive Branch, insofar as they manage procedures, services, records, data or platforms involved in the provision of proactive services.
Likewise, it grants the functional leadership, the methodological guidance, the articulation of the National Portfolio by Life Events, the issuance of guidelines, standards and technical instruments, as well as the monitoring and evaluation of the implementation of this regulation, to the Ministry of Public Administration, without prejudice to the constitutional or legal powers attributed to the other responsible entities.
The Government Office of Information and Communication Technologies (Ogtic) will be responsible for the implementation, integration, operation and support of the transversal technological solutions required for the execution of the model, in accordance with the guidelines issued by the MAP and without replacing the substantive competencies of the entities responsible for the service.
The ministries and directorates that will adopt proactive services will retain jurisdiction over eligibility rules, sectoral operations, administrative acts, case management and the quality of the data under their responsibility.
Constitutionally autonomous bodies, city councils and municipal district boards are excluded from the scope of application of the regulations, with respect to which the adoption of the principles, standards and mechanisms provided for in this regulation will have an exhortative nature.
Also excluded are services, procedures, records, data, platforms and administrative actions that are not under the dependence or supervision of the Executive Branch, or that are not linked to the provision of proactive services in the terms provided for in this regulation.
Within the framework of the National Strategy for Proactive Services 2026–2028, at the end of April of this year the Ministry of Public Administration (MAP), together with the Cabinet of Social Policies, the Ministry of Public Health, the National Health Service (SNS), the Supérate Program, the Single System of Beneficiaries (Siuben), and the Hugo Mendoza and Reynaldo Almánzar hospitals, began a series of workshops for the design, development and implementation of proactive services, an initiative that promises to transform the management model of public services.
A proactive service is defined as the provision in which the anticipatory State detects relevant events in people's lives and activates services without prior request, preserving traceability, control and the ability to claim.
The decree defines as an Anticipatory State the public management model aimed at identifying and timely addressing foreseeable needs of people through coordinated action, interoperability and legitimate use of data.

El ministro de Administración Pública,Sigmund Freund, mostró su satisfacción con esta disposición e indicó que con este reglamento se da inicio a unnuevo modelo de gestión públicaque colocará al país a lavanguardiade la transformación de los servicios públicos en la región. “Este es un proceso que nos permite pasar de un modelo de administración reactiva y burocrática hacia un Estado anticipatorio que se fundamente en la interoperabilidad segura y el intercambio de datos entre nuestras instituciones, y así poder, mediante la detección automática de lo que conocemos como eventos de vida, como el nacimiento, la educación, el empleo, la jubilación, definir de manera proactiva los servicios que se requerirán a futuro”,manifestó Freund. Finalidad, rectoría y ámbito de aplicación La disposición del Poder Ejecutivo refiere que el reglamento tendrá como finalidad impulsar la transición progresiva hacia una administración pública capaz deactuar de oficio ante eventos de vida o condiciones de elegibilidad legalmente verificadas. El decreto define como ámbito de aplicación obligatoria a losministerios, órganos, entes y organismos de la Administración Pública central y descentralizadafuncionalmente, bajo dependencia o tutela del Poder Ejecutivo, en cuanto gestionen trámites, servicios, registros, datos o plataformas involucrados en la prestación de servicios proactivos. Asimismo, otorga larectoría funcional, laconducciónmetodológica, laarticulacióndel Portafolio Nacional por Eventos de Vida, la emisión delineamientos, estándares e instrumentos técnicos, así como el seguimiento y evaluación de la implementación del presente reglamento, alMinisterio de Administración Pública, sin perjuicio de las competencias constitucionales o legales atribuidas a las demás entidades responsables. La Oficina Gubernamental de Tecnologías de la Información y Comunicación(Ogtic)será responsable de la implementación, integración, operación y soporte de lassoluciones tecnológicas transversalesrequeridas para la ejecución del modelo, conforme a los lineamientos emitidos por el MAP y sin sustituir las competencias sustantivas de las entidades responsables del servicio. Los ministerios y direcciones que adoptarán los servicios proactivos conservarán la competencia sobrelas reglas de elegibilidad, la operación sectorial, los actos administrativos,la atención de los casos y la calidad de los datos bajo su responsabilidad. Del ámbito de aplicación de la normativa quedanexcluidoslosórganos constitucionalmente autónomos, losayuntamientos y las juntas de distritos municipales, respecto de los cuales la adopción de los principios, estándares y mecanismos previstos en este reglamento tendrácarácter exhortativo. También se excluyen los servicios, trámites, registros, datos, plataformas y actuaciones administrativas que no se encuentren bajo dependencia o tutela del Poder Ejecutivo, o que no estén vinculados a la prestación de servicios proactivos en los términos previstos en este reglamento. En el marco de laEstrategia Nacional de Servicios Proactivos 2026–2028, a finales de abril de este año el Ministerio de Administración Pública (MAP), junto con el Gabinete de Políticas Sociales, al Ministerio de Salud Pública, al Servicio Nacional de Salud (SNS), al Programa Supérate, al Sistema Único de Beneficiarios (Siuben), y los hospitales Hugo Mendoza y Reynaldo Almánzar, iniciaron unaserie de tallerespara el diseño, desarrollo e implementación de servicios proactivos, una iniciativa que promete transformar el modelo de gestión de los servicios públicos. Se define como servicio proactivo la prestación en la que el Estado anticipatorio detectaeventos relevantes en la vida de las personas y activa servicios sin solicitud previa, conservando trazabilidad, control y capacidad de reclamo. El decreto define como unEstado Anticipatorioal modelo de gestión pública orientado a identificar y atender oportunamente necesidades previsibles de las personas mediante actuación coordinada, interoperabilidad y uso legítimo de datos.
