Denis Mukwege à Félix Tshisekedi : « Je ne vous écris pas pour vous souhaiter une bonne fête nationale, car il n’y a rien à célébrer »

From the start of his letter, Denis Mukwege states: “I am not writing to wish you a happy national holiday, because there is nothing to celebrate: the Nation is in existential crisis and in danger of balkanization or annexation, and the suffering of Congolese citizens, deprived of everything, has crossed the threshold of what is humanly tolerable. »
Returning to the accession of Félix Tshisekedi to the presidency, he indicates having observed “a certain reserve as a patriot” in order to “give a chance after the dark years of the Kabila regime”.
He adds, however: “I did not insist on the fact that you had arrived at the supreme office following a secret agreement and that your entry into office perpetuated a crisis of legitimacy for the leaders of the institutions of the Republic. »
About the break between the CACH-FCC coalition and the creation of the Sacred Union of the Nation, Denis Mukwege writes: “You have formed a new coalition, the Sacred Union of the Nation, largely committed to your cause and to your family, both biological and political, more than to any vision. »
The former presidential candidate also looks back on his meeting with President Tshisekedi, in November 2020, at the Palais de la Nation.
“I did not cry about authoritarian drift and even came to the Palais de la Nation in November 2020, animated by a spirit of constructive dialogue,” he wrote.
He specifies that he wanted to convince the Head of State “to mobilize political will to place transitional justice at the heart of your efforts in order to free the country from the culture of impunity”.
In this same letter, Denis Mukwege recalls having publicly urged the president “not to make the Sacred Union an oasis of criminals”, before adding: “The observation today is bitter. »
On transitional justice, he claims to have pleaded “several times” for “the creation of a special criminal court for crimes committed in the DRC, including those listed in the Mapping Report”.
According to him, “despite your repeated promises to refer the matter to the United Nations Security Council, it is clear that nothing has been done until today.”
Addressing the state of siege established in April 2021 in the provinces of North Kivu and Ituri, Denis Mukwege recalls having warned about the temporary nature of this measure.
“This exceptional measure, which restricts fundamental rights and freedoms, was not intended to last over time,” he writes, stressing that “this state of siege has been renewed to this day.”
He also believes that this measure “paradoxically contributed to a deterioration of the security situation, an increase in the number of civilian victims and an alarming deterioration of the human rights situation”.
He adds: “Your choice to appoint military governors whose past is listed in the UN Mapping Report did not place this measure under promising auspices. »
In his letter, Denis Mukwege also criticizes the agreements concluded with the Ugandan and Burundian armies.
“I had expressed in due time my concern about this policy of externalization of national security by those involved in the destabilization of the country, which was akin to an arsonist-firefighter strategy,” he wrote.
According to him, “this dangerous amateurism has largely contributed to the internationalization of the conflict in the sub-region, with the resurgence of the M23 and the umpteenth illegal war of aggression and occupation led by the Rwandan army, which continues to this day.”
The Congolese doctor also criticizes the multiplication of regional diplomatic initiatives.
“You have wrongly multiplied conflict resolution initiatives without any coordination or vision (EAC, SADC, AU, Luanda, Doha, Washington, etc.), creating more confusion than pacification,” he asserts.
Regarding the DRC's membership in the East African Community, he writes: “I have warned that this organization is largely made up of states more attracted by their commercial and geostrategic interests in the DRC than by the protection of civilians. »
He also mentions the deployment of the regional force of the EAC, considering that it had “an unclear mandate and without prior authorization from the National Assembly”.
Denis Mukwege considers that this situation has contributed “to a worrying overmilitarization in a region where we aspire to silence the guns”.
Regarding the Nairobi and Doha processes, he said: “You must have known that you were providing arguments to our aggressors, who have always sought to pass off the crisis in eastern DRC as an internal conflict, when its international character is obvious. »
The Nobel Peace Prize also returns to the question of the withdrawal of MONUSCO.
According to him, the request for accelerated withdrawal of the UN mission “raised the question of who you are really working for: the vital interests of the DRC or those of Rwanda? »
He also cites the economic agreement signed with Rwanda on June 26, 2021.
“You took everyone by surprise by signing, on June 26, 2021, against all expectations and common sense, an economic agreement with Rwanda to formally exploit and market the minerals of Kivu,” he wrote.
Denis Mukwege indicates that he pleaded for the maintenance of MONUSCO, including in South Kivu.
“I had invited the government and our compatriots not to choose the wrong enemy,” he recalls, believing that “a hasty withdrawal of the UN mission would leave a vacuum conducive to the enemies of peace.”
In the last part of his letter, he returns to the Addis Ababa Framework Agreement for peace, cooperation and security in the Great Lakes region.
“I have returned several times to the need to revitalize the Addis Ababa Framework Agreement,” he wrote, describing this text as an “Agreement of Hope”.
He affirms that this agreement notably provided for “the reform of the security sector and institutions”.
Denis Mukwege finally accuses the government of not having initiated these reforms: “You preferred to continue the mess of the outgoing president aimed at depriving our country of a republican army capable of protecting our borders, of an experienced police force to protect the population and of well-trained intelligence services to prevent any attempt at destabilization. »
According to him, “these reforms are, however, essential preconditions for safeguarding national integrity and sovereignty.”

Dès l’entame de sa lettre, Denis Mukwege affirme : « Je ne vous écris pas pour vous souhaiter une bonne fête nationale, car il n’y a rien à célébrer : la Nation est en crise existentielle et en danger de balkanisation ou d’annexion, et la souffrance des citoyens congolais, privés de tout, a franchi le seuil de ce qui est humainement tolérable. » Revenant sur l’accession de Félix Tshisekedi à la présidence, il indique avoir observé « une certaine réserve en tant que patriote » afin de « donner une chance après les sombres années du régime Kabila ». Il ajoute toutefois : « Je n’avais pas insisté sur le fait que vous étiez arrivé à la magistrature suprême à la suite d’un accord secret et que votre entrée en fonction faisait perdurer une crise de légitimité des animateurs des institutions de la République. » À propos de la rupture entre la coalition CACH-FCC et de la création de l’Union sacrée de la Nation, Denis Mukwege écrit : « Vous avez constitué une nouvelle coalition, l’Union sacrée de la Nation, largement acquise à votre cause et à votre famille, tant biologique que politique, plus qu’à une quelconque vision. » L’ancien candidat à la présidentielle revient également sur sa rencontre avec le président Tshisekedi, en novembre 2020, au Palais de la Nation. « Je n’ai pas crié à la dérive autoritaire et suis même venu au Palais de la Nation en novembre 2020, animé par un esprit de dialogue constructif », écrit-il. Il précise avoir voulu convaincre le chef de l’État « de mobiliser une volonté politique pour placer la justice transitionnelle au cœur de vos efforts afin de sortir le pays de la culture de l’impunité ». Dans cette même lettre, Denis Mukwege rappelle avoir exhorté publiquement le président à « ne pas faire de l’Union sacrée une oasis de criminels », avant d’ajouter : « Le constat aujourd’hui est amer. » Sur la justice transitionnelle, il affirme avoir plaidé « plusieurs fois » pour « la création d’un Tribunal pénal spécial pour les crimes commis en RDC, y compris ceux répertoriés dans le Rapport Mapping ». Selon lui, « malgré vos promesses répétées de saisir le Conseil de sécurité des Nations unies, force est de constater que rien n’a été entrepris jusqu’à aujourd’hui ». Abordant l’état de siège instauré en avril 2021 dans les provinces du Nord-Kivu et de l’Ituri, Denis Mukwege rappelle avoir alerté sur le caractère temporaire que devait revêtir cette mesure. « Cette mesure exceptionnelle, qui restreint les droits et les libertés fondamentales, n’avait pas vocation à durer dans le temps », écrit-il, soulignant que « cet état de siège a été renouvelé jusqu’à ce jour ». Il estime par ailleurs que cette mesure « a paradoxalement contribué à une détérioration de la situation sécuritaire, à une augmentation du nombre de victimes civiles et à une dégradation alarmante de la situation des droits humains ». Il ajoute : « Votre choix de nommer des gouverneurs militaires dont le passé est répertorié dans le Rapport Mapping de l’ONU ne plaçait pas cette mesure sous des auspices prometteurs. » Dans sa lettre, Denis Mukwege critique également les accords conclus avec les armées ougandaise et burundaise. « J’avais exprimé en temps utile mon inquiétude face à cette politique d’externalisation de la sécurité nationale par les acteurs de la déstabilisation du pays, qui s’apparentait à une stratégie de pyromane-pompier », écrit-il. Selon lui, « cet amateurisme dangereux a largement contribué à l’internationalisation du conflit dans la sous-région, avec la résurgence du M23 et l’énième guerre illégale d’agression et d’occupation menée par l’armée rwandaise, qui perdure jusqu’à ce jour ». Le médecin congolais critique également la multiplication des initiatives diplomatiques régionales. « Vous avez multiplié, à tort, les initiatives de résolution des conflits sans aucune coordination ni vision (EAC, SADC, UA, Luanda, Doha, Washington, etc.), créant davantage de confusion que de pacification », affirme-t-il. À propos de l’adhésion de la RDC à la Communauté d’Afrique de l’Est, il écrit : « J’avais mis en garde sur le fait que cette organisation est composée en grande partie d’États davantage attirés par leurs intérêts commerciaux et géostratégiques en RDC que par la protection des civils. » Il évoque également le déploiement de la force régionale de l’EAC, estimant qu’elle disposait « d’un mandat peu clair et sans autorisation préalable de l’Assemblée nationale ». Denis Mukwege considère que cette situation a contribué « à une surmilitarisation inquiétante dans une région où l’on aspire à faire taire les armes ». Concernant les processus de Nairobi et de Doha, il affirme : « Vous deviez savoir que vous étiez en train de fournir des arguments à nos agresseurs, qui ont toujours cherché à faire passer la crise dans l’Est de la RDC pour un conflit interne, alors que son caractère international est patent. » Le Prix Nobel de la paix revient aussi sur la question du retrait de la MONUSCO. Selon lui, la demande de retrait accéléré de la mission onusienne « posait la question de savoir pour qui vous travaillez réellement : les intérêts vitaux de la RDC ou ceux du Rwanda ? » Il cite également l’accord économique signé avec le Rwanda le 26 juin 2021. « Vous aviez pris de court tout le monde en signant, le 26 juin 2021, contre toute attente et tout bon sens, un accord économique avec le Rwanda pour exploiter et commercialiser formellement les minerais du Kivu », écrit-il. Denis Mukwege indique avoir plaidé pour le maintien de la MONUSCO, y compris au Sud-Kivu. « J’avais invité le gouvernement et nos compatriotes à ne pas se tromper d’ennemi », rappelle-t-il, estimant qu’« un retrait précipité de la mission onusienne laisserait un vide propice aux ennemis de la paix ». Dans la dernière partie de sa lettre, il revient sur l’Accord-cadre d’Addis-Abeba pour la paix, la coopération et la sécurité dans la région des Grands Lacs. « Je suis revenu plusieurs fois sur la nécessité de redynamiser l’Accord-cadre d’Addis-Abeba », écrit-il, qualifiant ce texte d’« Accord de l’espoir ». Il affirme que cet accord prévoyait notamment « la réforme du secteur de la sécurité et des institutions ».
