The Head of State first recalled that this law is part of the normal functioning of the institutions of the Republic and in respect of the principle of separation of powers.
He then announced that he had referred the matter to the Constitutional Court so that it could examine the conformity of this law with the Constitution before any possible promulgation.
“Regarding the referendum law, adopted by both chambers of Parliament, I would like to recall that it is part of the normal functioning of our institutions and the principle of separation of powers. In a democratic Republic, Parliament debates, deliberates and legislates. The President of the Republic, guarantor of the proper functioning of institutions, exercises the prerogatives conferred on him by the Constitution. The competent courts, for their part, ensure respect for the constitutional order and the rule of law. It is in this spirit of interinstitutional cooperation and respect for the rule of law that I referred this law to the Constitutional Court for the purposes of examining its constitutionality before its possible promulgation, in accordance with article 160, paragraph 3, of our Constitution,” declared Félix Tshisekedi.
According to him, this approach is based on a deep republican conviction.
“In a democracy, no decision, no matter how important, can be free from the rules, procedures and guarantees imposed on us by the fundamental law. The Republic does not close the door to any of its children as long as they choose the path of dialogue, respect for institutions and loyalty to the nation,” he added.
The law establishing the conditions for organizing referendums in the Democratic Republic of Congo was adopted by both houses of Parliament before the close of the ordinary session in March.
For the opposition, this text opens the way to a referendum aimed at modifying the Constitution in order to allow the regime of Félix Tshisekedi to remain in power for a long time. The parliamentary majority, on the other hand, maintains that it simply aims to fill a legal void.

Le chef de l'État a d'abord rappelé que cette loi s'inscrit dans le fonctionnement normal des institutions de la République et dans le respect du principe de séparation des pouvoirs. Il a ensuite annoncé avoir saisi la Cour constitutionnelle afin qu'elle examine la conformité de cette loi à la Constitution avant toute éventuelle promulgation. « S'agissant de la loi référendaire, adoptée par les deux chambres du Parlement, je tiens à rappeler qu'elle relève du fonctionnement normal de nos institutions et du principe de séparation des pouvoirs. Dans une République démocratique, le Parlement débat, délibère et légifère. Le président de la République, garant du bon fonctionnement des institutions, exerce les prérogatives que lui confère la Constitution. Les juridictions compétentes, quant à elles, veillent au respect de l'ordre constitutionnel et de l'État de droit. C'est dans cet esprit de coopération interinstitutionnelle et de respect de l'État de droit que j'ai déféré cette loi à la Cour constitutionnelle aux fins d'examen de sa constitutionnalité avant sa promulgation éventuelle, conformément à l'article 160, alinéa 3, de notre Constitution », a déclaré Félix Tshisekedi. Selon lui, cette démarche repose sur une profonde conviction républicaine. « Dans une démocratie, aucune décision, aussi importante soit-elle, ne saurait s'affranchir des règles, des procédures et des garanties que nous impose la loi fondamentale. La République ne ferme la porte à aucun de ses enfants dès lors qu'ils choisissent la voie du dialogue, du respect des institutions et de la loyauté envers la nation », a-t-il ajouté. La loi fixant les conditions d'organisation des référendums en République démocratique du Congo a été adoptée par les deux chambres du Parlement avant la clôture de la session ordinaire de mars. Pour l'opposition, ce texte ouvre la voie à un référendum visant à modifier la Constitution afin de permettre au régime de Félix Tshisekedi de se maintenir durablement au pouvoir.
