AyA elimina obstáculos al desarrollo
•Modification to regulations allows more projects to begin construction procedures
March 6, 2024. The AyA reformed the Service Provision Regulations, in order to expedite housing, commerce, tourism and industry projects that have been stagnant for years. This is an example of the direction that this new Administration is taking to the institution.
According to Juan Manuel Quesada, president of AyA: "This institution must be built as an ally of the country's development and not an obstacle. In addition, AyA must have the capacity to do so quickly, as in this case."
In 2023, the AyA received 23,272 requests nationwide for procedures to obtain proof of water availability, of which 22% were rejected for not having the pipe in front of the property, for lack of water or for not meeting minimum legal requirements. 17% of these negative applications were for individual homes or businesses and 5% were denied for developments involving more than one property.
The modification of the regulations will allow the granting of certificates of water capacity in places where infrastructure is being or is being contemplated by AyA or Asadas and there is flow in the system. This improvement will allow interested parties to begin their construction procedures.
With the previous Cva norm, the operator's promise was to offer water, taking into consideration its ability to develop infrastructure over a 12-month horizon. With the approved reform, the water capacity certificates will take into consideration the projects to be developed in the next 36 months. This means that, with the reform, the viability of developing housing, condominiums, shops, tourism and industry projects in the country is expanded.
Quesada added that “we are eliminating a major obstacle to development and in parallel with this we must continue working to make the planning and execution of AyA projects much more efficient.”
The AyA Board of Directors approved the reform, which is in the process of formalization and will come into effect upon its publication in La Gaceta.
The AyA reminds that the issuance of the certificate is free and can be requested through the customer service offices throughout the country or through the telephone line 800 7376783. The AyA has 15 business days to provide a response to the interested party.

La modificación del reglamento permiCrá el otorgamiento de constancias de capacidad hídrica en lugares donde se esté o se tenga contemplando desarrollar infraestructura por parte del AyA o Asadas y exista caudal en el sistema. Esta mejora permiCrá a los interesados el inicio de sus trámites de construcción. Con la anterior normaCva, la promesa de del operador era ofrecer agua, tomando en consideración su capacidad de desarrollar infraestructura en un horizonte de 12 meses. Con la reforma aprobada, las constancias de capacidad de agua tomarán en consideración los proyectos a desarrollar en los siguientes 36 meses. Esto significa que, con la reforma, se amplía la viabilidad de desarrollar proyectos de vivienda, condominios, comercios, turismo e industria en el país. Quesada agregó que “estamos eliminando un gran obstáculo al desarrollo y paralelo a ello debemos seguir trabajando en hacer mucho más eficiente la planificación y ejecución de los proyectos del AyA”. La Junta DirecCva del AyA aprobó la reforma la cual se encuentra en proceso de formalización y entrará a regir a parCr de su publicación en La Gaceta. El AyA recuerda que la emisión de la constancia es gratuita y puede ser solicitada a través de las oficinas de atención al cliente en todo el país o por medio de la línea telefónica 800 7376783. El AyA cuenta con 15 días hábiles para brindar una respuesta al interesado.
